COMMISSION IMPLEMENTING REGULATION (EU) 2024/1270

correcting Implementing Regulation (EU) 2023/2466 laying down rules for the application of Regulation (EU) No 1308/2013 of the European Parliament and of the Council as regards marketing standards for eggs
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) No 1308/2013 of the European Parliament and of the Council of 17 December 2013 establishing a common organisation of the markets in agricultural products and repealing Council Regulations (EEC) No 922/72, (EEC) No 234/79, (EC) No 1037/2001 and (EC) No 1234/2007 (1), and in particular Article 90a(6), point (c), and Article 91, first subparagraph, points (b), (f) and (g), thereof,
Whereas:

Commission Implementing Regulation (EU) 2023/2466 (2), which lays down rules for the implementation of marketing standards for certain eggs, contains several errors and omissions. |
|
(2) |
In all language versions of Implementing Regulation (EU) 2023/2466, Article 8 and Article 9(5) includes a reference to Articles 4, 5 and 6 of that Implementing Regulation. Since Article 4 of that Implementing Regulation concerns the marking of eggs and has no reference to records, Article 8 and Article 9(5) of Implementing Regulation (EU) 2023/2466 should instead refer to Articles 5, 6 and 7 of that Implementing Regulation. |

In the German language version of Implementing Regulation (EU) 2023/2466, Article 9(1) is missing a reference to Commission Delegated Regulation (EU) 2023/2465 (3). |

(4) |
In the Italian language version of Implementing Regulation (EU) 2023/2466, recitals 1 and 6 and articles 2, 5, 7, 8, 9 and 10 are missing references to Delegated Regulation (EU) 2023/2465. |

In all language versions of Implementing Regulation (EU) 2023/2466, Article 10(3) is missing a reference to Part VI of Annex VII to Regulation (EU) No 1308/2013. |

Implementing Regulation (EU) 2023/2466 should therefore be corrected accordingly. |

The measures provided for in this Regulation are in accordance with the opinion of the Committee for the Common Organisation of the Agricultural Markets, |
HAS ADOPTED THIS REGULATION:
Article 1
Implementing Regulation (EU) 2023/2466 is corrected as follows:

Article 8 is replaced by the following: ‘Article 8 Time limits for keeping records Records and files referred to in Article 7(2) of Delegated Regulation (EU) 2023/2465 and Articles 5, 6 and 7 of this Regulation shall be kept for at least 12 months from the date of their creation.’ |

in Article 9, paragraph 5 is replaced by the following: ‘5. Inspections shall be conducted regularly and be unannounced. Records referred to in Articles 5, 6 and 7 shall be made available on first request to the inspection services.’ |

in Article 10, paragraph 3 is replaced by the following: ‘3. The inspection service which made the check shall verify whether the rejected batch has been or is being made to comply with this Regulation, Delegated Regulation (EU) 2023/2465 or Part VI of Annex VII to Regulation (EU) No 1308/2013.’ |
Article 2
This Regulation shall enter into force on the third day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.
